A New And Different Housing Bubble Is Taking Shape In US


We have seen it for several years now: foreclosure sales—there were 5 million since the peak of the housing bubble—have become the hunting grounds for investors with two goals: hanging on to these homes until the Fed’s flood of money drives up their value; and defraying the expenses of ownership by renting them out. And funds have a third goal: collecting management fees.
Thousands of smaller investors have piled into the game. And so have the giants.
Blackstone Group LP, the world’s largest private equity firm, plowed over $3.5 billion into the housing market, according to Bloomberg, to gobble up 20,000 vacant and foreclosed single-family homes. It just fattened up a credit line to $2.1 billion to do more of the same. Colony Capital LLC, which already owns 7,000, is putting $2.2 billion to work.
Last year, institutional investors made up 19% of all sales in Las Vegas, 21% in Charlotte, 23% in Phoenix, and 30% in Miami.

Part Time Agents Make RE/MAX Look Good!

I did some research this week on 2012 TREB statistics and here is what I found.

Number of agents registered on TREB: +36,729
Number of agents who did one deal or more: +20,738
Number of units sold on TREB: 97,254
Total dollar value of sales on TREB: $47,057,472,569

Number of agents who did two or more deals: 13,998!!!!

Number of agents who did 3 or more deals: 10,109!!!!

So over 1/4 of all agents in TREB statistics did 0 deals on TREB! Astounding!

6,740 agents did one deal on TREB!

1000 agents did two deals on TREB!

How do they feed their families? They must have another source of income I guess!

What a crazy way to run an industry!

RE/MAX agents did 50,539 transaction bueyr and seller ends last year, the highest success rate of any real estate brand. So over 27% of all transactions on TREB were done by RE/MAX in the GTA last year! That is success!

Now, what about RE/MAX? The average agent from RE/MAX does 10.1 transaction ends on TREB alone not to mention the exclusive, new build and referral business they do.  So no wonder the part time agents make us look so good!

I read a Facebook blog from a major competitor today showing over 80 of their agents in Wednesday night training! WOW! I guess they were too busy working at their real job so they could not make  the day time training we put on!
Do not fool yourself! You can make a very good living at real estate but only by taking your career, your business, seriously as a full time, committed Realtor!

Anything else is just part time! And that makes RE/MAX look really good!
That's my thoughts anyway.....

Is Flaherty taking anti-competitive action on interest rates?

Flaherty wants to end the interest rate wars! Who does he think he is any way!
Let's look at the facts.
Manulife offered mortgages to customers who qualified at a very low 2.89%. This is hardly a war. Let's see. That amounts to a savings of, well, .002% per year. Even compounded semi annually that means  .002 x $1,000 borrowed or $2 per year per thousand borrowed! Hardly earth shattering and not likely to be the determinant of anyone deciding to use Manulife for their mortgage.
Thank you Manulife! You did the right thing! You attempted to be competitive. I am certain you have underwriters who know your profitability at such levels. So congrats! You win!
In fact, if we look at the race to zero interest rates, few banks will lower their mortgage rates much further except to get our friendly mortgage brokers excited enough to pass their clients on for these "tremendous" mortgage rate savings.
My kids say I talk about the good old days too much. But, lets look back to 1981 when I paid +20% interest rates simply to run my small business of the day. Yes, I wrote +20%!  Will this happen again? I guess Flaherty's concern is yes. We just do not know when.
So Mr. Flaherty, you have every right to be concerned about the effect of an interest rate war. My bet is that the war will not be fought at the 3% interest rate level. No, it will be fought when consumers are again gouged by the big banks and the government like the 80's when we paid dearly. That is a war that will leave casualties just like it did in the 1980s, lost businesses and lost homes.
That said, let us take advantage of big businesses fighting for our business with still lower rates.
Or, Jim, are you just too concerned your big bank buddies cannot compete? Or are you just protecting the profits of those big bank buddies? Either way, you are anti-competitive tampering with the banks. That is the job of the Bank of Canada.
That is the way I see it, anyway!

When is a home matrimonial?

As Realtors we have been pounded on that when two married people have lived as a married couple in the same home, that the home is matrimonial and permission to sell the home is required by the non titled spouse simply to sell the home. Is that always the case?
Well, in lawyers words, that depends.
In a recent example a listing was held by a brokerage where one spouse had title. The other spouse had moved out of this home some time ago and the two, still married spouses lived in two separate homes. Was the original home a matrimonial home? Well that depends.
Most Realtors would say yes. The problem is, we are not lawyers but Realtors. We do not interpret the law. Nor do we write the law. We must live by what the law states only.
So, in this case, take the question to a higher authority, your. Broker, Manager or a lawyer who represents you or your client.
In this example the seller spouse on title stated it was not a matrimonial home. Just sell it and he would deal with all matrimonial issues. A review with the brokerages lawyer we found that the matrimonial status of the home was questionable. In fact, since both spouses owned a home, perhaps the home  for sale was not matrimonial.
So, could we sell it without a matrimonial spousal signature, yes. Would it be best to have that signature? Yes. But could we sell it and close it without on?  Yes.
So there is no straight answer for this question. If you ask five lawyers, you will get five answers.

My answer, that depends! Guess I am sounding like a lawyer!

Isn't it dandy that the politicians attempt to claim the credit for OREA's push for modernizing the real estate transaciton!  I highly praise the Conservwtive member for putting this private members bill forward once again. Remember it died when parliament was proroged last fall. It takes initiative for any member  to bring forward a very positive change. Do I need to disclose!

One of the most controversial questions in real estate today is do I need to disclose some issue on a property I am selling or I am representing as a Realtor? I believe the question is not do I disclose but what is my obligation to my client? What are my duties and responsibilities to the person I am representing?
My opinion only, as a long term Realtor, Broker and Mentor to literally thousands or Realtors is definitively, "Yes! You should disclose!"
In they press for several years a competent legal expert has stated, in a well know newspaper that you should not disclose as the statement of disclosure might lead to legal actions due to some perceived error in the disclosure of the truth.
In some cases there have been issues that may not be a simple decision as to whether they need disclosure. Some one dies in a home. Is it necessary to disclosed? The home had a foundation that leaked but I fixed it professionally. Should I disclose? My Neighbour is a bad person and difficult to live next to. Must I disclose?
The fact of the matter is simple in my mind and that of Mark Weisleder well known Lawyer and real estate lecturer, you should disclose truths know by the seller and you, the Realtor, simply to prevent a lawsuit. One duty of a Realtor is the Duty of Competence, a Competent Realtor will tell any seller they must disclose any Latent Defect for a property, something that a willing Buyer would want to know in order to make a reasonable decision of the property's  utility for them and the amount they would offer to purchase the Proeprty for. To me this is a simple act and decision for any property I represent, disclose known defects in writing and before any offer decision.
Yes, my client may be sued if his disclosure statement is inaccurate, but he will be sued if he does not disclose a known issue of importance for a property. The defense is much simpler when the disclosure is done in a well intended, accurate manner. So, in my, non lawyer but Realtor opinion, disclose!
